End User License Agreement (EULA)

This End User License Agreement ("EULA") governs your use of any software, SDKs, sample code, documentation, or other downloadable materials made available by Kalmantic as part of the jusInfer platform (collectively, the "Software"). It supplements our Terms of Service.
Plain-English summary. We grant you a non-exclusive, non-transferable license to use the jusInfer SDK and any sample code we publish. You can use it in your own projects, including commercial ones. You can't redistribute it as part of a competing inference router. You can't claim it's your own work or remove our notices.
1. License grant
Subject to your compliance with the Terms of Service, this EULA, and applicable law, Kalmantic grants you a worldwide, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Install, copy, and run the Software for your internal business use and personal use
- Integrate the Software into your applications, including commercial applications
- Modify the Software for your own use
2. Restrictions
You may not:
- Redistribute the Software as a standalone product, SDK, or service
- Use the Software to build a service that primarily competes with the jusInfer routing layer
- Sell, sublicense, rent, or lease the Software (you may, however, distribute applications that internally use the Software, provided those applications add substantial functionality of your own)
- Remove or alter any copyright, trademark, or proprietary notice in the Software
- Use Kalmantic or jusInfer trademarks except to truthfully identify Kalmantic products and services
- Reverse-engineer, decompile, or disassemble the Software except to the extent permitted by applicable law notwithstanding this restriction
3. Open-source components
The Software may include open-source components, each governed by its own license. Where an open-source component's license terms conflict with this EULA, the open-source license governs that component. A list of open-source components and their licenses is included with the Software where applicable.
4. Ownership
Kalmantic retains all rights, title, and interest in the Software except for the limited license granted in Section 1. Your modifications to the Software are your property, but the underlying Software remains ours.
5. Sample code
Any code samples, snippets, or example projects we publish (in our documentation, blog, or GitHub) are provided as-is. You may use, modify, and redistribute them without attribution. We make no warranty that sample code is correct, secure, or fit for any particular purpose.
6. Updates
We may publish updates to the Software. Updates may add, remove, or change functionality. We are not obligated to maintain any particular version of the Software indefinitely. Continued use of the Software after an update is your acceptance of the updated version.
7. Termination
This EULA continues until terminated. We may terminate this EULA immediately if you violate it. You may terminate this EULA by uninstalling the Software and destroying all copies in your possession.
Upon termination, your license ends. Sections 4, 8, 9, 10, and 11 survive termination.
8. Disclaimer of warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9. Limitation of liability
KALMANTIC'S TOTAL LIABILITY UNDER THIS EULA WILL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. IN NO EVENT WILL KALMANTIC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. Government end users
If you are an agency or department of the U.S. government, the Software is "commercial computer software" and "commercial computer software documentation" under 48 C.F.R. 12.212 / 227.7202. Your use is governed solely by this EULA.
11. Governing law
This EULA is governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles.
